1. Introductory provisions

These terms and conditions define and specify the rights and obligations of the Seller and the Buyer in the contractual relations concluded through the website www.irisauctions.com (hereinafter referred to as the website). The Buyer has the opportunity to familiarize himself with these Terms and Conditions prior to placing his order or interacting with us (e.g. through a personal meeting with gallery representatives), as well as during your participation in or registration for auction days and is notified of them sufficiently in advance. By submitting your order, the Buyer confirms that they have read and agree to these Terms and Conditions. The seller and the gallery operator and data controller of www.irisauctions.com is:

All contractual relations are governed by the law of the Czech Republic. If the contracting party is a consumer, relations not regulated by these Terms and Conditions shall be governed by Act No. 40/1964 Coll., the Civil Code (hereinafter referred to as the "Civil Code"), and Act No. 634/1992 Coll., on Consumer Protection. If the contracting party is a buyer who is not a consumer, the relations not governed by these terms and conditions are governed in particular by Act No. 513/1991 Coll., Commercial Code (hereinafter referred to as the "Commercial Code").

 

2. Definition of terms

Consumer contract - a contract of sale, a contract for work or other contracts under the Civil Code where the parties to the contract are on the one hand the consumer and on the other hand the seller. Consumer - a natural person who, when concluding and performing a contract, is not acting within the scope of his trade or other business activity or within the scope of his independent exercise of his profession. Non-consumer buyer - a person who, when concluding and performing a contract, is acting in the course of his trade or business or in the course of his profession.

 

3. Information collected

The controller may collect and process the following personal data about you:

  • Identification data, this data includes in particular: first name, last name, username, title, date of birth, birth number/ID number,

  • Contact details, these details include in particular: mailing/billing address, email, telephone number;

  • Payment and Transaction Data, this data includes in particular: bank and payment details, order, payment and receivables history;

  • Technical data, this data includes in particular: information about your visits to the Website and the sources from which you accessed it;

  • Profile Data , this data includes in particular: your order history with us, your interests and preferences regarding the services and products you request from us, feedback, participation in auction days;

  • Marketing Data this data includes, in particular: your preferences in relation to the Administrator's marketing materials and your preferred method of communication;

  • Video footage (CCTV at the premises)

  • Correspondence records (when contacted in writing)

 

Personal data are stored for the period necessary to carry out the aforementioned purposes, in the case of entering into a contract, the processing period is defined by the duration of the specific contractual relationship and subsequently for the period of the statutory limitation periods (at most ten years from the date of the respective contractual relationship), in the case of the performance of our legal obligations, the processing period is imposed by the relevant legal regulations.

 

4. Security

Your personal data is stored via secure servers in our IT systems in the Czech Republic. No personal data is transferred to countries outside the European Union. We are committed to ensuring the security of your personal data. To prevent unauthorised access or disclosure, we have put in place appropriate technical and organisational procedures and measures to protect and secure the information we collect on the Website. You acknowledge that the personal data you provide to us will be managed in a systematic way using automatic, manual and any other information system tools.

 

5. Privacy Policy

All personal data provided to the Seller will not be disclosed to third parties or other entities without the Buyer's consent and will be handled in accordance with Act No. 101/2000 Coll., on the protection of personal data. The Buyer may request their modification or deletion at any time by e-mail. The Buyer can change his/her data on the website www.irisauctions.com or by telephone.

 

6. Final Arrangements

These terms and conditions allow the consumer to archive and reproduce them.
